2. License, Not Ownership
When you purchase or receive access to Brock Industries digital products, you are purchasing a license to use the materials under the applicable license terms. You are not purchasing ownership of the intellectual property.
All downloadable files, templates, workbooks, SQL examples, documents, dashboards, graphics, explanations, frameworks, and related materials remain the property of Brock Industries unless otherwise stated in writing.
Your rights are limited to the license type purchased.
3. License Types
Brock Industries may offer several license types. The license type purchased determines how the materials may be used.
Individual Practitioner License
The Individual Practitioner License is for one named person using the files for their own professional work.
This license allows one individual to use the materials for their own internal work as an employee, contractor, analyst, planner, scheduler, inventory professional, maintenance manager, reliability professional, Maximo administrator, functional consultant working internally, or similar practitioner.
This license does not allow sharing files with coworkers, uploading files to shared repositories, using the files with clients, reselling the files, repackaging the files, or distributing the files to others.
Unless another license is selected, the standard purchase includes an Individual Practitioner License.
Team / Site License
The Team / Site License is for internal use by a defined team, department, plant, facility, or operating site.
This license allows authorized users within the licensed team or site to use and adapt the materials for internal maintenance, reliability, inventory, Maximo, planning, scheduling, KPI, reporting, and improvement work.
Unless otherwise stated on the order form or invoice, this license applies to one site or one team only. It does not allow enterprise-wide use, consultant use, client use, resale, public distribution, or sharing outside the licensed scope.
Enterprise License
The Enterprise License is for broader internal use across the licensed organization, subject to the scope stated in the order form, invoice, quote, or written agreement.
This license may allow use across multiple internal sites, departments, business units, or regions, depending on the purchased scope.
The Enterprise License allows internal adaptation, internal training, internal standardization, and internal deployment. It does not allow consultant use, client use, resale, public distribution, or use by unrelated entities unless expressly authorized in writing.
Consultant / Commercial Use License
The Consultant / Commercial Use License is required for consultants, trainers, advisors, system integrators, service providers, or other commercial users who intend to use the materials in paid client work.
This license may allow use of the materials as accelerators in consulting, implementation support, advisory work, training, KPI reviews, dashboard planning, or client-specific analysis.
Unless expressly allowed in writing, the Consultant / Commercial Use License does not allow the licensee to give editable source files to clients, resell the materials, repackage the materials, upload the materials to client repositories as reusable templates, remove Brock Industries ownership notices, or create a competing product based on the materials.
Clients who need ongoing access to editable source files must purchase the appropriate license from Brock Industries unless written permission is granted.
4. What You May Do
Depending on the license purchased, you may be allowed to:
• Download the purchased files.
• Use the files within the scope of your license.
• Modify editable files for permitted internal use.
• Use workbooks, SQL examples, templates, and checklists to support business analysis and improvement.
• Create internal outputs such as completed reports, charts, KPI reviews, screenshots, recommendations, action plans, and summary findings.
• Use the materials to support Maximo-related analysis, configuration planning, reporting, and process improvement.
• Store the files in a controlled internal location if your license allows shared internal use.
Your use must stay within the purchased license scope.
5. What You May Not Do
Unless you receive written permission from Brock Industries, you may not:
• Share the files outside the purchased license scope.
• Email, copy, upload, or distribute the files to unauthorized users.
• Upload the files to public websites, public forums, public repositories, social media platforms, open file-sharing services, or unrestricted portals.
• Upload individual-license files to SharePoint, Teams, Google Drive, OneDrive, Dropbox, intranets, learning management systems, client portals, or company-wide repositories where unauthorized users can access them.
• Use an Individual, Team/Site, or Enterprise License for client work.
• Use the files in paid consulting, training, advisory, or implementation services unless you have purchased a Consultant / Commercial Use License.
• Resell, sublicense, repackage, bundle, publish, post, distribute, or give away the files.
• Convert the files into your own downloadable product, template pack, course, membership resource, software product, or competing offer.
• Remove copyright notices, license notices, ownership language, attribution, or Brock Industries branding from source files.
• Claim ownership of Brock Industries materials.
• Use the materials in a way that violates applicable law, software license agreements, company policies, data security rules, or third-party rights.
6. Digital Downloads
Digital products may be delivered by direct download, email link, account access, or another delivery method.
You are responsible for downloading and storing your purchased files. Brock Industries is not responsible for lost files after successful delivery, although we may choose to provide replacement access at our discretion.
Download links may expire, be limited by time, or be limited by number of downloads.
You may not share download links with others.
7. Refund Policy for Digital Products
Because digital products can be copied, downloaded, and used immediately, all sales of digital products are final once access has been provided, unless otherwise required by law or expressly stated in a product-specific guarantee.
We may, at our discretion, provide a refund, replacement file, corrected file, store credit, or other remedy if there is a verified technical issue with the download or if the wrong product was delivered.
Refunds are not provided because:
• You changed your mind after downloading the product.
• You purchased the wrong license type.
• You no longer need the product.
• Your Maximo environment requires customization.
• You expected the files to work without testing or modification.
• You do not have the required software to open or use the files.
• Your organization does not permit use of downloaded files.
• You disagree with the license restrictions after purchase.

8. Physical Products
Physical books or printed products may be sold directly through this website or through third-party platforms.
Shipping times, print quality, return handling, and fulfillment may vary depending on the fulfillment provider.
Physical books do not automatically include digital files unless the product description specifically says they do.
Companion downloads, field kits, implementation bundles, or toolkit files may require a separate purchase or license.
9. Products Purchased Through Third-Party Platforms
Some Brock Industries products, including physical books, may be available through third-party platforms such as Amazon, other online retailers, or authorized resellers.
Products purchased through third-party platforms are subject to that platform's purchase terms, return policies, and customer service processes. Brock Industries does not control and is not responsible for third-party return handling, shipping, refund timing, or fulfillment issues.
Physical books purchased through third-party platforms do not automatically include access to digital companion files, implementation bundles, deploy kits, update pages, or other downloadable resources unless the product description on the third-party platform specifically states otherwise.
Digital products, companion files, deploy kits, implementation bundles, and update access purchased separately through brockindustries.store are governed by these Terms and Conditions regardless of where the related physical book was purchased.
If you purchased a physical book through a third-party platform and wish to purchase companion digital files, visit brockindustries.store and select the appropriate product and license type.
10. Updates
Some products may include access to updates for a stated period, such as 12 months from purchase.
Updates are not guaranteed unless expressly stated on the product page, order form, or invoice.
If updates are provided, they are subject to the same license restrictions as the original product.
Update access may require an active account, active license, proof of purchase, or renewal.
Brock Industries may modify, improve, rename, replace, retire, or discontinue products at any time.
11. No Guarantee of Results
Brock Industries products are designed to help professionals think through problems, analyze data, improve processes, configure tools, and apply practical business methods.
However, we do not guarantee that use of our products will produce a specific operational, financial, reliability, maintenance, inventory, compliance, software, or business result.
Results depend on many factors outside our control, including but not limited to:

12. Maximo, SQL, and Technical Use Warning

Do not run untested SQL, scripts, formulas, or configuration changes in production.

You are responsible for ensuring that your use of the materials complies with your organization’s data security, privacy, confidentiality, and access control requirements.

15. Intellectual Property
All Brock Industries materials, including but not limited to text, templates, workbooks, calculations, SQL examples, checklists, graphics, product names, frameworks, layouts, training structures, documentation, and downloadable files, are protected by copyright and other applicable laws.
You may not copy, reproduce, distribute, publish, modify for resale, publicly display, publicly perform, sublicense, or create competing products from the materials except as expressly allowed by your purchased license.
Unauthorized use may result in termination of your license and may subject you to legal action.
16. Trademarks and No Affiliation
IBM, Maximo, Maximo Application Suite, MAS, and related product names are trademarks or registered trademarks of their respective owners.
Brock Industries is an independent provider of educational, implementation, and professional resources. Brock Industries is not affiliated with, sponsored by, endorsed by, or authorized by IBM unless expressly stated in writing.
References to IBM Maximo or related products are for identification, education, compatibility discussion, and practical implementation context only.
17. User Accounts and Access
Some products may require an account, login, order email, license key, download code, or proof of purchase.
You are responsible for maintaining the confidentiality of your account credentials and purchase information.
You may not share your account, download links, access credentials, license keys, or purchase confirmation with unauthorized users.
Brock Industries may suspend or terminate access if we believe an account, license, download link, or product file is being misused.

19. Product Descriptions

Product images, mockups, screenshots, previews, and marketing graphics are for illustration and may not show every file or exact final appearance.

To the fullest extent permitted by law, Brock Industries’ total liability for any claim related to a purchased product is limited to the amount you paid for that product.

23. Termination
Brock Industries may terminate or suspend your license, account access, or download access if you violate these Terms and Conditions or the applicable product license.
Upon termination, you must stop using the Licensed Materials and delete or restrict unauthorized copies.
Termination does not limit Brock Industries’ right to pursue remedies for unauthorized use, distribution, resale, or infringement.
24. Changes to These Terms
Brock Industries may update these Terms and Conditions at any time.
The version posted on this website is the current version. Changes become effective when posted unless otherwise stated.
For previously purchased products, the license terms included with the product or shown at the time of purchase generally apply, unless a later update is required by law or accepted by the purchaser.
25. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of laws provisions.
Any legal action or proceeding arising under or related to these Terms and Conditions, any product purchase, any license, or any use of Brock Industries materials shall be brought exclusively in the state or federal courts located in Norfolk, Virginia, and you consent to the personal jurisdiction of those courts.
26. Dispute Resolution
Before initiating any formal proceeding, you agree to contact Brock Industries in writing and allow 30 days to attempt informal resolution.
If informal resolution is unsuccessful, any dispute, claim, or controversy arising from or relating to these Terms and Conditions, any product, any license, or any use of Brock Industries materials shall be resolved by binding arbitration administered in Norfolk, Virginia, in accordance with the rules of the American Arbitration Association.
The arbitration shall be conducted by a single arbitrator. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Each party shall bear its own costs and attorneys' fees unless the arbitrator determines that a claim was frivolous, in which case the arbitrator may award reasonable costs and fees to the prevailing party.
Nothing in this section prevents Brock Industries from seeking injunctive or equitable relief in any court of competent jurisdiction to protect intellectual property, enforce license restrictions, or prevent unauthorized distribution of materials.
